I have a smokestack or Tangle Wire in play and my opponent has an Oath in play.  Durring his upkeep does he oath first then do the stack or wire effects or the other way around?  Is it his/her choice which he/she does first or mine?

Whenever two or more effects would go on the stack at the same time, they are applied APNAP - Active Player, Non-Active Player.  In this case, his Oath goes on the stack, then your Smokestack/Tangle Wire goes on the stack above it and resolves first.  If you have both Smokestack and Tangle Wire, you choose which order they go on the stack, but they both go on the stack above the Oath trigger.

Here's the relevant section on handling triggered abilities.  Notice how the controller of the ability controls the stack order if multiple items would go on at the same time (i.e. the Stax player chooses whether to tap, then sac or sac, then tap).

also note that since the Oath ability resolves last, the tap/sac wouldn't stop a hasted creature from attacking.
