Dear Mr. ****,

It appears that Transmute Artifact was drastically mispriced in our system. We apologize for removing them from your order. We are crediting your store credit account for their balance. Other than this mishap, I hope you enjoyed the site.

Sincerely,

i have had a bad experience with them too.  It seems my cards i was sending for their buylist haven't yet reached them.  It's been over a month...

2 were Gaea's Cradles so i'm losing a chunk of cash on this.

Unfortunately, they can do this.  I had a similar experience at Amazon a few years ago.  I saw a DVD at $13 when the normal retail price was like $30, and I was rather shocked to be informed that my order was cancelled and I couldn't get it at that price.  Perhaps one of our lawyers can explain why (I guess it has something to do with the purchase not being made until the item is actually shipped).  I don't think it's good business practice, but as far as I know it is legal.  They cannot, however, change the price after it is shipped and expect you to pay the difference.

The new price of $17 is totally outrageous, and I wouldn't buy from them based on gouging.  It's like how this one gas station near my house gouged the prices the day after 9/11.  I haven't been back to that gas station since.

Sorry for breaking Transmute, dudes Smile

Um, obviously law shit isn't the same in holland as in the USA, but over here it works like this. If an article (in a regular store, so I guess it goes for an online store, too) is mispriced, the seller is required to sell it at the listed (lower) price if the difference with the actual price is <10%.

I once checked this because I worked parttime in a computer store. If our computer (and our advertismenets, for example) listed a graphics card at 100 euro, and some jackass in the back stickered it for 90, then we're basically screwed and forced to sell it at 90 if the customer desires such. If he stickered it at 50, we can say 'sorry thanks no deal' like what happened with the transmutes.

In short: if it were a Dutch store, if they have it listed at >3,30 now, they're in the clear.

In New Zealand law (which is based on British common law, much like the Canadian, Australian and American systems), a price sticker and/or advertising is an invitation to make an offer i.e. a guide to a fair offer. That said, laws also ban false advertising (particularly bait and switch tactics, as opposed to a genuine mistake).

In this case, however, the 'paid for' is a somewhat more thorny issue. I would argue that once the payment has been accepted, a legally binding contract to supply the goods has been entered into. An incorrect price sticker or advert is one thing, but if I were to go to a shop and actually pay for something at the wrong price, that's a whole lot further along the path.
