I sent this question to WOTC. No response yet.  Any info from TMD users is appreciated.

Dear Ask Wizards,

Foil DCI Judge promos of Phyrexian Negator have been showing up for sale on on-line stores and auction sites.  Are these cards real?  If so, isn't this a violation of your reprint policy?

The promotional Phyrexian Negators would be an example of a premium card, and therefore not covered under the reprint policy.

Agreed.  But, the entire section says this:

Special-Purpose Reprints

All policies described in this document apply only to non-premium, tournament-legal Magic cards. Wizards of the Coast has and may continue to print special versions of cards not meant for regular game play, such as oversized cards.

A little vauge.  It can be interpreted to mean that WOTC doesn't think people will play with their DCI Foil cards in tournaments.  Maybe I'll get a response from WOTC.  But, I'm guessing it will be simply WOTC quoting the above paragraph.

"Non-premium" is what matters there.
