I have a Vial out with 2 counters on it. At the end of my opponents turn I activate my AEther Vial. I response my opponent plays an Oxidize on my Vial. When the ability of AEther Vial resolves, do I get to put a creature with cc of 2 or 0 into play?

2. The ability checks the last known information of the vial, and sees that it had 2 counters just before it died.

Well that sure sucks. That mean I've lost a ton of games with affinity I shouldn't have.  Sad
Anyway, thanks for giving me a answer, at least now i know.

EDIT: Is the same also true for Kiki-Jiki, Mirror Breaker? Say I have a Kiki-Jiki out along with a Eternal Witness. I activate the Kiki-Jiki targeting the Witness. In response my opponent destroys the Witness. Do I still get a copy of the Eternal Witness?

In this case you do not.  This is because Kiki's ability targets the witness, and only the witness, and when it goes to resolve, all of its targets are illegal, so the whole ability is countered on resolution.  Aether vial doesnt have any targets, so the ability resolves whether its in play or not, and when an ability tries to check an attribute of a permanent thats not in play anymore, it goes with the last known value.  Another example, i have a spikeshot goblin, and use it to ping you.  In response you: 1) cast terror.  The spikeshot dies, then you take 1 damage, since that was his last known power   2) cast echoing decay.  The spikeshot again dies, but you take no damage, because when the ability resolves, his last known power was 0 or less, hence he does no damage.  Thats why your vial still puts out a 2mana critter, when the ability resolves, it checks the last known attribute.

Dang, that is an excellent example, LHC (the Terror vs. Decay one). I would probably have got that wrong on a test.

K, I think I get it now, thanks.  Very Happy Just to make sure though, does this also applies to Smokestack and Tangle Wire? I have a Wire out with 3 counters at the end of my turn. My opponent destroys it his upkeep, does he still needs to tap any permanents? I think he does because the game would check the last know information which would be three counters right?
