Black and Blue Magic is hosting the Lorwyn Sealed Deck on Sunday for a Wii, as well as buying and selling all weekend long.  I sent these people $1176.92 in cards, and they have not paid me, and refuse to answer their phone/e-mail.  I would love to be able to resolve the issue.  Anyone I know, or even anyone I don't' know, who wants to help me out here would be greatly appreciated.  I would consider making the trip myself, but I am hosting an event on the same day.

Thanks,
Eric

So I got in touch with David Hayes via the Hotel the Grand Prix was hosted at.  I talked to him for about 20 seconds before he told me "You calll me here?  While I'm working, now you're really going to have a hard time getting your money!"  So that's apparently how Black and Blue Magic/ David Hayes works.  This is flagrant theft by swindle of nearly $1200 worth of cards.  Avoid Black and Blue Magic and David Hayes.

Wow, that really sucks. What are your options at this point?

I can't say I'm surprised by this.  I tried selling cards to these guys 2 years ago at GP Toronto when they had a booth and it was by far the most painful experience with a dealer I ever had.  They kept berating me when I said no to their prices.  It was unbelievable.

I made a mental note then to avoid these guys like the plague but it seems they only do Canadian events.  I'm sorry to hear you're currently having trouble with them and I hope you get your money.

Im pretty sure this constitutes as mail fraud, and is therefore handled by the FBI.  Ive made claims like these before, with little success but it maybe your best option.

I had a simmilar experience as dave at gen con last year but we just made fun of them for having bullshit dealer prices and ended up getting really sweet deals.  So i guess being an asshole may pay off.

Sounds like the Gaming Pit here in Atlanta. Aside from being generally unfriendly the few times I've been in there, the prices are nuts.

Example: Buying Kataki at .45 and selling for $8.

My only concern is getting paid.  The issue is David Hayes not holding up his end of our contract.  I will be getting paid, I just haven't determined the best way of making that happen at this point.  For now, I warn the community to not deal with blackandbluemagic.com or David Hayes.

If you want, you can make a post about this on roguegaming.com (local magic site for Vancouver). I am sure there are many people on there that know the guy personally that you can possibly use as a resource to get your money and/or cards back.

Sorry, it seems like you're not the only seller who has been ripped by these guys.

No offense intended, but why would anyone in their right mind mail $1,200 worth of cards to someone they don't know very well?!  Especially when that someone lives in another state appx. 1,400 miles away.

There's really no practical recourse in this instance other than complaining to the Magic community.  The FBI has much much bigger fish to fry.  Maybe you could get one of those daytime TV judge shows to take the case.

Thanks for all the help.  I have finally been contacted by David after contacting some people close to him.  He apologized, and attempted to explain himself.  The issue isn't resolved, but if things do not work out, I will make sure to both get my money the old fashioned way, as well as make sure his reputation is unrepairable.  Still, I am hopeful that he has simply had cash flow issues and just managed the situation badly.

The address listed on the website is about a mile away from my place.  I don't know this guy, but judging from the address, I'd say you're right about the cash flow issues.  While this part of Minneapolis isn't the worst around, it isn't exactly the Hamptons either.  No one lives in my area because they want to, it's because that's all they can afford.
